Bijou Phillips has filed to remove Danny Masterson’s surname from their daughter’s name. The 45-year-old actress, who filed for divorce from the former That ’70s Show actor two years ago following his 30-years-to-life prison sentence for raping two women, has submitted new court documents requesting that 11-year-old Fianna Francis take her own last name. The filing is currently awaiting a judge’s approval.

In a separate legal development on Friday (24 October 2025), a judge updated both Phillips and Masterson’s legal statuses to single. Despite their divorce, Bijou previously provided a character statement in court, highlighting that Masterson remains in daily contact with their daughter. She said: “Danny is an amazing father. Our daughter and I are heartbroken that he is not home with us. Even though he is now in jail, he calls her every day and helps her with homework every night.”
Bijou originally filed for divorce shortly after Masterson’s sentencing, citing “irreconcilable differences” for the breakdown of their 11-year marriage. Her lawyer noted at the time: “Ms Phillips’ priority remains with her daughter. This period has been unimaginably hard on the marriage and the family. Mr Masterson was always present for Ms Phillips during her most difficult times. She hopes that everyone will respect her family’s privacy in these difficult times.”

Masterson agreed to give Bijou full legal and physical custody of their daughter while retaining visitation rights, and the court was asked to divide their assets as separate property. Last year, Bijou was romantically linked with businessman Jamie Mazur, with sources revealing that the relationship had given her a renewed outlook on life. “After Danny was found guilty, Bijou had a hard time. She has been incredibly sad for their daughter. It’s just so awful that she lost her dad. Bijou has leaned on a small group of friends for support since she filed for divorce,” an insider told People magazine.
